NOTICE TO BIDDERS

 

PLEASE TAKE NOTICE that pursuant to a Resolution of the Board of Fire Commissioners of the Hampton Bays Fire District, Town of Southampton, County of Suffolk, New York, as unanimously passed by the Board at an official public meeting of the Board convened on September 16, 2026,  and as enacted pursuant to the results of the special election and public referendum conducted by the District on August 25, 2026, wherein the majority of the eligible voters of the District passed and approved a referendum authorizing the sale of portions and parcels of the Hornet real property still currently owned by the Hampton Bays Fire District at 84 West Montauk Highway, Hampton Bays, New York as hereinafter described as no longer needed for Fire District or Fire Department purposes, and permitting, pursuant to New York State law, the sale and purchase of the property pursuant to qualified bids in the minimum amount of $1,000,000 (One Million Dollars), in total for the two (2) parcels of real property described in the referendum, resolution and herein, sealed bids for the sale of the Hornet Property lots and parcels of the real property still currently  owned by the Hampton Bays Fire District at 84 West Montauk Highway, Town of Southampton, County of Suffolk, State of New York, tax map descriptions and designations: District 0900, Section 223.00, Block 02.00, Lot 004.003, and District 0900, Section 223.00, Block 02.00, Lot 004.002 moreover the portion, parcels and lots thereof, further known and designated as Lot 1 and Lot 3 hereinafter described, which real property is no longer necessary for the uses of the Hampton Bays Fire District or the Hampton Bays Fire Department will be received at the office of the Board of Fire Commissioners at the Hampton Bays Firehouse, 69 W. Montauk Hwy, Hampton Bays, NY until and no later than 7:00 pm (prevailing Eastern Standard time) on November 4, 2026 with no extension of time to be granted, at which time they will be publicly opened by the District Secretary David G. Van Scoy Sr. in the presence of the Board of Fire Commissioners and read aloud.

Bids by qualified bidders to be considered must be sealed bids submitted by being mailed or delivered to the office of the Board of Fire Commissioners at the aforesaid address and received by the District Secretary in sealed envelopes at the above address and shall bear on the face thereof the name and address of the bidder and the words “Bid Proposal for the Purchase of Hampton Bays Fire District Hornet Property pursuant to special election and referendum of August 25, 2026 and Resolution of Board of Fire Commissioners of the Hampton Bays Fire District dated September 16, 2026.”

A non-collusive bidding certificate and affidavit must accompany the bid. The non-collusive bidding certificate and affidavit must be executed by the bidding party or managing officer or member of the bidding party or entity and be duly notarized by a notary public duly and currently qualified and authorized to act in the State of New York. The required non-collusion bidding certificate and affidavit must state as follows:

NON-COLLUSION AFFIDAVIT AND CERTIFICATE 2026

 Made pursuant to Section 103-d of the General Municipal Law of the State of New York and Pursuant to the Fiduciary Duties, Authority and Requirements Established by the Hampton Bays Fire District Board of Fire Commissioners With Respect to Sealed Bids for the Sale and Purchase of District Real Property at 84 West Montauk Highway, Hampton Bays, New York (also known as parcels of the  “Hornet Property”) Pursuant to Special Election and Public Referendum Approval of August 25, 2026.

By submission of this bid, each bidder and each person signing on behalf of any bidder certifies, and, in the case of a joint bid, each party thereto certifies as to its own organization, under penalty of perjury that to the best of knowledge and belief:

 

1.    The prices in this bid have been arrived at independently without collusion, consultation, communication, or agreement, for the purpose of restricting competition, as to any matter relating to such prices with any other bidder or competitor;

 

2.    Unless otherwise required by law, the prices which have been quoted in this bid have not been knowingly disclosed by the bidder and will not knowingly be disclosed by the bidder prior to opening, directly or indirectly, to any other bidder or to any competitor;

 

3.    No attempt has been made or will be made by the bidder to induce any other person, partnership or corporation to submit or to not submit a bid for the purpose of restricting competition.

 

4.    The undersigned affirms that he/she is duly authorized, individually or by corporate or business resolution, as required effective as of the date of this Affidavit and Certificate and the bid and to submit the bid and sign this document and any other agreements related to the project or transaction as proposed.

The proposed transaction and terms of the proposed contract for the above proposed sale and purchase of real property, which shall remain subject to Board approval and approval of District General Counsel, will be awarded by the Board of Fire Commissioners to the highest responsible bidder submitting a qualified bid fully compliant with the bid requirements and after consultation with its legal counsel. In cases where two (2) or more responsible bidders submit identical bids, the Board of Fire Commissioners may award the contract to either of such bidders. The Board of Fire Commissioners reserves the right to reject all bids and re-advertise for new bids in its discretion with all rights reserved by the Board and the District.

No bids may be withdrawn by any bidder for a period of forty-five (45) days from the date of the bid opening.
